Nebraska Waives Hours of Service Regulations for Fuel Haulers

On November 1, Governor Ricketts of Nebraska issued Executive Order 22-06 to provide emergency relief of regional fuel shortages. This order permits drivers to work extended hours to haul gasoline or gasoline blends, diesel, fuel oil, ethanol, propane, and biodiesel.

The Hours of Service requirements under 49 CFR Part 395 are temporarily waived through November 30, 2022. Drivers wishing to exercise this waiver must carry a copy of Executive Order 22-06 with them. Additional rules and restrictions apply, including that ill or fatigued drivers must not operate a vehicle. This order does not apply to the interstate system.

Nebraska joins Iowa and South Dakota for recently issuing hours of service waivers for fuel hauling. NTTC staff will continue to monitor these and developing emergency declarations, and will broadcast updates when available.
